Association à but non lucratif déclarée sous le régime de la Loi du 1er Juillet 1901 et du Décret du 16 Août 1901 (J.O. N° 46 du 13 Novembre 1985) Article premier Il est fondé entre les adhérents aux présents statuts une Association régie par la Loi du 1er Juillet 1901 et le Décret du 16 Août 1901, ayant pour titre : Association Internationale des Juristes du Droit de la Vigne et du Vin. (en anglais : International Wine Law Association) Article 2 Cette Association, à vocation d'information et de proposition, a pour but d'étudier sous tous ses aspects le droit de la Vigne et du vin. Elle apporte son concours aux Organismes Nationaux et Internationaux concernés et notamment à l'O.I.V. (Organisation Internationale de la Vigne et du Vin). Article 3 : Siège social Le siège social est fixé à PARIS, Organisation Internationale de la Vigne et du Vin (OIV) -18, rue d'Aguesseau - 75008 PARIS. Il pourra être transféré par simple décision du Conseil d'Administration. Article 4 : Composition L'Association se compose de : a) Membres d'Honneur b) Membres Fondateurs c) Membres Adhérents Article 5 : Admission Pour faire partie de l'Association, il faut être agréé par le Bureau qui statue sur les demandes présentées. Article 6 : Les Membres Sont membres d'honneur, les personnes physiques ou morales qui ont rendu des services signalés à l'Association. Ils sont nommés par l'Assemblée Générale sur proposition du Conseil d'Administration et peuvent être dispensés de cotisations. Les membres fondateurs sont les personnes physiques ou morales qui, jusqu'au 1er Juillet 1993, ont versé un droit d'entrée et une cotisation annuelle fixés par l'Assemblée Générale. Sont membres adhérents, les personnes physiques ou morales qui versent annuellement une cotisation également fixée par l'Assemblée Générale. La cotisation des personnes morales, supérieure à celle des personnes physiques, les autorise à désigner trois personnes en leur sein pour participer aux activités de l'Association, étant précisé que les personnes morales ne disposent que d'une voix à l'Assemblée Générale. Article 7 : Radiations La qualité de membre se perd par : a) la démission b) le décès c) la radiation prononcée par le Conseil d'Administration, l'intéressé ayant été préalablement invité par lettre recommandée à se présenter devant le bureau pour fournir des explications sur les motifs invoqués. Article 8 : Ressources Les ressources de l'Association comprennent : 1. Le montant des droits d'entrée et des cotisations 2. Les subventions, dons et legs, acceptés par le Conseil d'Administration. Article 9 : Conseil d'Administration L'Association est dirigée par un Conseil d'Administration composé de 30 membres maximum élus pour 3 années par l'Assemblée Générale et des Présidents de sections prévues à l'Article 13. Les membres du Conseil sont rééligibles. Le Conseil d'Administration choisit parmi ses membres un bureau, composé de : 1. Un président élu pour 3 ans et non immédiatement rééligible. 2. Un ou plusieurs vice-présidents 3. Un secrétaire général et, s'il y a lieu, un secrétaire général adjoint 4. Un trésorier et, si besoin est, un trésorier adjoint. Article 10 : Réunion du Conseil d'Administration Le Conseil d'Administration se réunit une fois au moins par an sur convocation du Président, ou sur la demande du quart de ses membres, la convocation devant être adressée au moins 2 semaines à l'avance. Pour que le Conseil soit valablement réuni, un tiers au moins de ses membres doivent être présents ou représentés. Les décisions sont prises à la majorité des voix des membres présents ou représentés; en cas de partage, la voix du Président est prépondérante. Les membres du Conseil absents peuvent être représentés par un autre membre du Conseil porteur d'un pouvoir écrit à la condition qu'aucun membre ne dispose de plus de 3 voix. Le Président peut décider de procéder à un vote par correspondance. Tout membre du Conseil qui, sans excuse, n'aura pas assisté à trois réunions consécutives ou ne s'y sera pas fait représenter, pourra être considéré par le Conseil d'Administration comme démissionnaire. Nul ne peut faire partie du Conseil s'il n'est majeur. Le Président peut également inviter à ces réunions, avec voie consultative, toute personne qu'il jugera utile. Article 11 : Assemblée Générale Ordinaire L'Assemblée Générale Ordinaire comprend tous les membres de l'Association à quelque titre qu'ils soient affiliés, à jour de leurs cotisations. L'Assemblée Générale Ordinaire se réunit chaque année en fin d'exercice. Un mois au moins avant la date fixée, les membres de l'Association sont convoqués par les soins du Secrétaire Général. L'Ordre du Jour est indiqué sur les convocations. Tout membre peut demander l'inscription d'une question à condition de l'adresser au Secrétaire Général 15 jours au moins avant la date de l'Assemblée. Le Président, assisté des membres du bureau, préside l'Assemblée et expose la situation morale de l'Association. Le Trésorier soumet les comptes de l'exercice à l'approbation de l'assemblée. Ne devront être traitées, lors de l'Assemblée Générale, que les questions inscrites à l'Ordre du Jour. Elle prend ses décisions à la majorité des suffrages exprimés. Chaque membre dispose d'une voix. En cas d'absence, il peut se faire représenter par un autre membre de l'Assemblée Générale porteur d'un pouvoir écrit, à la condition qu'aucun membre ne dispose de plus de 5 voix. Le Conseil d'Administration pourra décider de procéder à un vote par correspondance. Article 12 : Assemblée Générale Extraordinaire Si besoin est, ou sur la demande de la moitié plus un des membres inscrits, le Président peut convoquer une Assemblée Générale Extraordinaire, suivant les formalités prévues par l'article 11. Article 13 : Sections Régionales Afin de réaliser les objectifs de l'Association dans un cadre géographique déterminé, le Conseil d'Administration peut créer des sections régionales dont les présidents sont membres de droit du Conseil d'Administration. Les sections régionales peuvent percevoir des cotisations spécifiques auprès de leurs membres afin de financer leurs activités régionales, étant précisé que nul ne peut être membre d'une section régionale s'il n'est à jour de sa cotisation à l'Association Internationale. Article 14 : Règlement Intérieur Un règlement intérieur peut être établi par le Conseil d'Administration qui le fait alors approuver par l'Assemblée Générale. Ce règlement éventuel est destiné à fixer les divers points non prévus par les statuts, notamment ceux qui ont trait à l'administration interne de l'Association. Declared Non Profit Association governed by the French law of July 1st , 1901 and the Decree of August 16th , 1901 (J.O. N° 46 of November 13, 1985) Article 1 The adherents to the present statutes agree to found an association, governed by the French law of July 1st, 1901 and the Decree of August 16th , 1901 entitled: Association Internationale des Juristes du Droit de la Vigne et du Vin. (in English : International Wine Law Association) Article 2 The purpose of this Association, with a vocation of information and proposal, is to study vine and wine law under all its aspects. It assists relevant national and international organizations and, in particular, the O.I.V. (International Organization of Vine and Wine). Article 3 - Headquarters The headquarters are located in Paris, Organisation internationale de la Vigne et du Vin (OIV) 18, rue d'Aguesseau, 75008 Paris. They may be changed by simple decision of the Board of directors. Article 4 - Composition The Association is composed of a) Honorary Members b) Founder Members c) Active Members Article 5 - Admission To be part of the Association, a member must be accepted by the Bureau which resolves admission requests. Article 6 - Members Honorary members are individual or corporate members who have rendered outstanding services to the Association. They are named by the General Assembly on proposition by the Board of directors and can be exempted from contributions. Founder members are the individual or corporate members who, until July 1st, 1993, paid a joining fee and an annual contribution fixed by the General Assembly. Active members are individual or corporate members who annually pay a contribution fixed by the General Assembly. The contribution of corporate members, higher than that of individual members, authorizes them to nominate three persons to take part in the activities of the Association, however corporate members have only one vote in the General Assembly. Article 7 - Terminations Membership is lost by: a) resignation b) death c) termination pronounced by the Board of directors. The relevant member having been invited beforehand by registered letter to be present before the Bureau to provide explanations for the reasons for termination. Article 8 - Resources The resources of the Association include: 1. The amount of joining fees and contributions 2. Subsidies, gifts and legacies, accepted by the Board of directors. Article 9 - Board of Directors The Association is managed by a Board of directors, made up of a maximum of 30 members, elected for 3 years by the General Assembly, and of the Presidents of sections envisaged in Article 13. The members of the Board are re-eligible. The Board of directors chooses among its members a Bureau, composed of: 1. A president elected for 3 years and not immediately re-eligible. 2. One or more vice-presidents 3. A secretary-general and, if necessary, an deputy secretary-general 4. A treasurer and, if need be, a deputy treasurer. Article 10: Board meeting The Board of directors meets at least once a year on convocation of the President, or by request of a quarter of its members, the convocation having been addressed to members at least 2 weeks in advance. For the validity of the Board meeting, a third at least of its members must be present or represented. Decisions are taken by majority of members present or represented; in the event of division, the President's vote shall decide. Absent members of the Board may be represented by another member of the Board by written proxy on condition that no member holds more than 3 votes. The President may decide to hold a postal vote. Any member of the Board who, without excuse, has not attended or been represented at three consecutive meetings, can be considered as having resigned from the Board of directors. Minors may not be elected to the Board. The President may also invite any person that he deems useful to meetings, in an advisory capacity. Article 11: General meeting The General meeting is open to all members of the Association, in whatever capacity , who are up to date with their contributions. The General meeting meets each year after the end of the financial year. At least one month before the set date, the members of the Association are convened by the Secretary-general. The Agenda is indicated on the convocations. Any member can request that a question be added, on condition that it be addressed to the Secretary-general at least 15 days before the date of the meeting. The President, assisted by the members of the Bureau, chairs the meeting and makes a statement on the overall situation of the Association. The Treasurer presents the financial year accounts for the approval of the meeting. During the General meeting, only questions entered on the Agenda are to be discussed. The meeting makes decisions on the majority of votes cast. Each member has one vote. In the event of absence, a member may be represented by another member of the General meeting by written proxy, on condition that no member holds more than 5 votes. The Board of directors may decide to hold a postal vote. Article 12: Extraordinary general meeting If needs be, or on the request of half plus one of the registered members, the President can convene an Extraordinary General meeting, in accordance with the formalities in article 11. Article 13: Regional sections In order to carry out the objectives of the Association within a given geographical framework, the Board of directors can create regional sections, whose presidents are members by right of the Board of directors. The regional sections can require specific contributions from their members in order to finance their regional activities, it being specified that nobody can be a member of a regional section if he or she is not up to date with contributions to the International Association. Article 14: Internal rules of procedure Internal rules of procedure can be established by the Board of directors for approval by the General meeting. Such Rules are intended to address issues not envisaged by these statutes, in particular those which deal with the internal administration of the Association. La question des opportunités n'est pas tellement légale, mais plus commerciale. Cette session débutera par un bref aperçu de la croissance du marché du vin en Chine, son taux de croissance, ses sources d'approvisionnement (locales et importation). La présentation préliminaire pouvait également décrire la nature du marché et des possibilités d'y pénétrer. Puis les aspects juridiques seront abordés, en traitant ou en commençant peut-être par les menaces très importantes auxquelles sont confrontées toutes les marques ayant une réputation, à savoir la contrefaçon et l'usurpation des marques en Chine, ayant des répercussions sur le marché chinois local et sur les marchés étrangers où les contrefaçons sont exportés. Cette partie de la session traitera les principaux problèmes de propriété intellectuelle, y compris obtenir l'enregistrement d'une marque de commerce en Chine, comment faire cela, que se passerait-il si un tiers obtient et enregistre votre marque avant vous et comment lutter contre les contrefaçons. Of course, Governments have the need to take a national view, commonly designed to deal with all industries or all agricultural sectors. This obviously raises a range of legal compliance problems for the wine sector which is faced with increasing regulations. Marina Silva was invited to discuss the political aspects that motivate the government. The AIDV speakers will identify sustainable environment laws now in place or foreshadowed or predicted for their region and, where appropriate, what problems or legal issues are raised by such laws. These laws include, for example: • obtaining and transferring the right to take water from the land (from bores, rivers, streams or even from collected rainfall) - known in some countries as water licences; • restrictions on the use of particular chemicals; • carbon production limitations; and • waste disposal. The question of opportunities is not so much a legal one, but a commercial one. This session will commence with a short overview of the growing Chinese wine market, it's growth rates, where it sources it's products (both local and imported) and so forth. The preliminary presentation could also describe the nature of the economy and one's ability to enter it. Then the legal aspects could then be addressed, touching on or perhaps starting with the very significant threats posed to all brands with any reputation, namely that of counterfeiting and of trade mark theft in China, having impacts on both the local Chinese market and on foreign markets to where counterfeits are exported. This part of the session would deal with the key IP issues, including obtaining registration of a Chinese trade mark, how to do that, what would happen if a third party gets in and registers your trade mark before you, and how to fight counterfeits. L'AIDV note le risque pour l'industrie vinicole d'être en fin de compte affectée à l'avenir par des propositions semblables à celles auxquelles d'autres industries sont actuellement confrontées, que de telles propositions pourraient avoir comme conséquence l'interdiction d'utiliser certains éléments graphiques des marques, ce qui pourrait constituer une interdiction de fait de l'utilisation de marques figuratives, privant ainsi les opérateurs de cette industrie de leurs droits de propriété intellectuelle. 5. Le droit des consommateurs à être informés implique, d'un côté, non seulement l'accès aux avertissements sanitaires sur les étiquettes, mais également par ailleurs, l'accès à d'autres éléments qui influencent le choix des consommateurs, y compris les symboles, les noms commerciaux, les marques, les droits d'auteur, les indications géographiques, les dessins, les modèles ou les allégations sanitaires. 6. Lorsque les propositions d'étiquetage sont faites sans preuve suffisante de nécessité ou de besoin du consommateur et sans considération des droits légitimes de propriété intellectuelle des opérateurs des industries affectées l'AIDV ne peut pas soutenir et s'oppose à ces propositions. 7. Également, l'AIDV exprime ses réserves et inquiétudes lorsque ces propositions n'ont pas pris en compte d'autres moyens de fournir des informations aux consommateurs par les nouvelles technologies qui peuvent être employées pour permettre aux consommateurs d'accéder aux informations dont ils peuvent avoir besoin au sujet des produits qu'ils souhaitent acheter. Aussi, en alternative à ces propositions extrêmes, l'AIDV recommande que d'autres moyens de fournir des informations aux consommateurs soient d'abord être considérés, développés et évalués. 8. L'AIDV ne soutient pas l'introduction de réglementations non-nécessaires et extrêmes qui priveraient les titulaires de droits de propriété intellectuelle de leurs droits exclusifs, au motif, notamment, que cela serait en opposition avec les dispositions des obligations de divers traités internationaux, y compris l'ADPIC ainsi que la Convention de Paris. 9. Intellectual property rights are a fundamental part of the assets of natural and legal persons. 2. As for the wine industry, current laws and regulations often require the use of its members' packaging and labelling for the publication of health warnings, which can have the effect of reducing the packaging and labelling space available for the use by the industry members. 3. The AIDV notes the proposed introduction of new measures in labelling and commercial communications (such as limiting the use of intellectual property rights or plain packaging laws)that could apply to many industries, including amongst others, food, wine and other alcoholic beverages sectors, , which could directly and substantially affect the intellectual property rights of members of those industries. 4. The AIDV notes the risk for the wine industry of eventually being affected in the future by similar proposals to those currently facing other industries, which proposals could result in the prohibition of using any graphical elements of trade marks, and which could effectively constitute the prevention of the use of figurative trade marks, thus depriving the members of that industry of their intellectual property rights. 5. Consumers´ rights to information mean, on the one hand, not only access to health warnings on labels, but also on the other hand, access to other items that influence consumers´ choice, including symbols, commercial or trading names, trade marks, copyright rights, geographical indications, designs and trade dress or health claims. 6. Where labelling proposals are made without sufficient evidence of necessity or consumer needs and without regard to the legitimate intellectual property rights of the members of the industries affected, the AIDV cannot support and opposes such proposals. 7. Equally AIDV expresses its reservations and concerns where the proposals have not considered other means of providing information to consumers by new technologies that can be used to gain access to such information that they may need about the products to be purchased. Thus, as an alternative to extreme proposals, the AIDV recommends that other means of providing information to consumers should first be considered, developed and evaluated. 8. The AIDV does not support the introduction of unnecessary or extreme regulations depriving owners of intellectual property rights of their exclusive rights on the basis that, amongst other considerations, it would be in breach of the provisions of various international treaty obligations, including TRIPS as well as the Paris Convention. 9. The AIDV emphasises that a deprivation of intellectual property rights would be equivalent to a partial (or in some cases total) expropriation of property. Thus although the AIDV opposes any such deprivation, should it occur, the AIDV emphasises that adequate and proper compensation should be paid. COMMISSION DECISION of 19 December 2008 rejecting an application for entry in the register of protected designations of origin and protected geographical indications provided for in Council Regulation (EC) No 510/2006 (Džiugas) (PGI) (notified under document number C(2008) 8423) COMMISSION DECISION of 19 December 2008 rejecting an application for entry in the register of protected designations of origin and protected geographical indications provided for in Council Regulation (EC) No 510/2006 (Germantas) (PGI) (notified under document number C(2008) 8430) The EC Regulation on Common Market Organisation in wines lays down: 27th whereas "(27) The concept of quality wines in the Community is based, inter alia, on the specific characteristics attributable to the wine's geographical origin. Such wines are identified for consumers via protected designations of origin and geographical indications, although the current system is not fully developed in this respect. In order to allow for a transparent and more elaborate framework underpinning the claim to quality by the products concerned, a regime should be established under which applications for a designation of origin or a geographical indication are examined in line with the approach followed under the Community's horizontal quality policy applicable to foodstuffs other than wine and spirits in Council Regulation (EC) No 510/2006 of 20 March 2006 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs (2) Article 34 Definitions 1. For the purposes of this Regulation, the following definitions shall apply: (a) "designation of origin" means the name of a region, a specific place or, in exceptional cases, a country used to describe a product referred to in Article 33(1) that complies with the following requirements: (i) its quality and characteristics are essentially or exclusively due to a particular geographical environment with its inherent natural and human factors; (b) "geographical indication" means an indication referring to a region, a specific place or, in exceptional cases, a country, used to describe a product referred to in Article 33(1) which complies with the following requirements: (i) it possesses a specific quality, reputation or other characteristics attributable to that geographical origin; Section 2 Application for protection Article 35 Content of applications for protection 1. Applications for protection of names as designations of origin or geographical indications shall include a technical file containing: (a) the name to be protected; (b) the name and address of the applicant; (c) a product specification as referred to in paragraph 2; (d) a single document summarising the product specification referred to in paragraph 2. 2. The product specification shall enable interested parties to verify the relevant conditions of production of the designation of origin or geographical indication. It shall consist at least of: (a) the name to be protected; (b) a description of the wine(s): (i) for wines with a designation of origin, its principal analytical and organoleptic characteristics; (ii) for wines with a geographical indication, its principal analytical characteristics as well as an evaluation or indication of its organoleptic characteristics; (c) where applicable, the specific oenological practices used to make the wine(s) as well as the relevant restrictions on making the wine(s); (d) the demarcation of the geographical area concerned; (e) the maximum yields per hectare; (f) an indication of the wine grape variety or varieties the wine (s) is obtained from; (g) the details bearing out the link referred to in Article 34(1) (a)(i) or, as the case may be, in Article 34(1)(b)(i); (h) applicable requirements laid down in Community or national provisions or, where foreseen by Member States, by an organisation which manages the protected designation of origin or geographical indication, having regard to the fact that such requirements shall be objective and nondiscriminatoryand compatible with Community law; (i) the name and address of the authorities or bodies verifying compliance with the provisions of the product specification and their specific tasks. Article 36 Application for protection relating to a geographical area in a third country 1. Where the application for protection concerns a geographical area in a third country, it shall contain in addition to the elements provided for in Article 35 proof that the name in question is protected in its country of origin. 2. The application shall be sent to the Commission, either directly from the applicant or via the authorities of the third country concerned. 3. The application for protection shall be filed in one of the official languages of the Community or accompanied by a certified translation into one of those languages. COUNCIL REGULATION (EC) No 510/2006 of 20 March 2006 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs Article 2 Designation of origin and geographical indication 1. For the purpose of this Regulation: (a) "designation of origin" means the name of a region, aspecific place or, in exceptional cases, a country, used to describe an agricultural product or a foodstuff: <ul id="s2h"><li> originating in that region, specific place or country, </li><li> the quality or characteristics of which are essentially or exclusively due to a particular geographical environment with its inherent natural and human factors, and </li><li> the production, processing and preparation of which take place in the defined geographical area;</li></ul> (b) "geographical indication" means the name of a region, a specific place or, in exceptional cases, a country, used to describe an agricultural product or a foodstuff: <ul id="s2h"><li> originating in that region, specific place or country, and </li><li> which possesses a specific quality, reputation or other characteristics attributable to that geographical origin, and </li><li> the production and/or processing and/ or preparation of which take place in the defined geographical area.</li></ul> Article 5 Application for registration 3. The application for registration shall include at least: (a) the name and address of the applicant group; (b) the specification provided for in Article 4; (c) a single document setting out the following: (i) the main points of the specification: the name, a description of the product, including, where appropriate, specific rules concerning packaging and labelling, and a concise definition of the geographical area, (ii) a description of the link between the product and the geographical environment or geographical origin referred to in Article 2(1)(a) or (b), as the case may be, including, where appropriate, the specific elements of the product description or production method justifying the link. COMMISSION REGULATION (EC) No 1898/2006 of 14 December 2006 laying down detailed rules of implementation of Council Regulation (EC) No 510/2006 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs Article 7 Link 1. Details bearing out the links referred to in point (f) of Article 4(2) of Regulation (EC) No 510/2006 shall provide an explanation how the characteristics of the defined geographical area affect the final product. 2. With regard to a designation of origin the product specification shall set out: (a) details of the geographical area, including natural and human factors, relevant to the link; (b) details of the quality or characteristics of the agricultural product or foodstuff essentially or exclusively due to the geographical environment; (c) description of the causal interaction between details referred to in point (a) and details referred to in point (b). 3. With regard to a geographical indication the product specification shall set out: (a) details of the geographical area relevant to the link; (b) details of the specific quality, reputation or other characteristics of the agricultural product or foodstuff attributable to the geographical origin; (c) description of the causal interaction between details referred to in point (a) and details referred to in point (b). 4. Mr Schneider is the owner of a vineyard in Rhineland-Pfalz, registered in the companies register under the name 'Consulat des Weins'. An inspection carried out in November 2002 established that Mr Schneider produced eight types of wine with labelling bearing the company name of his vineyard and the terms 'Grande Réserve' for two wines in the highest price bracket, 'Réserve' for four average priced wines and 'Terroir' or 'Terroir Palatinat' for two wines in the lowest price bracket. The Regional Inspectorate Trier: <ul id="s2h"><li> prohibited Mr Schneider from marketing the wine in question using the French terms 'Réserve' and 'Grande Réserve', </li><li> rejected Mr Schneider's complaint in which he stated that he was prepared to use the German terms 'Reserve' or 'Privat-Reserve' as a substitute for the French equivalents, </li><li> stated that the term 'Privat-Reserve' could not be accepted either. </li></ul> Appeals were dismissed. Eventually the Bundesverwaltungsgericht decided to refer a number of questions to the Court of Justice for a preliminary ruling. 1. Article 47(2)(c) of Council Regulation (EC) No 1493/1999 of 17 May 1999 on the common organisation of the market in wine, in conjunction with point (B)(3) of Annex VII thereto and Article 6(1) of Commission Regulation (EC) No 753/2002 of 29 April 2002 laying down certain rules for applying Regulation No 1493/1999 as regards the description, designation, presentation and protection of certain wine sector products, as amended by Commission Regulation (EC) No 1512/2005 of 15 September 2005, must be interpreted as meaning that the use of a particular relating to the production or ageing method or the quality of a wine may be permitted under those provisions only if there is no risk that it will mislead the persons to whom it is addressed by creating confusion between that particular and the other traditional terms referred to in the fifth indent of point (B)(1)(b) of Annex VII to Regulation No 1493/1999 and Article 23 of Regulation No 753/2002. It is for the national court to assess whether the terms in issue in the main proceedings are likely to give rise to such a risk. 2. Article 24(2)(a) of Regulation No 753/2002, as amended by Regulation No 1512/2005, is to be interpreted as meaning that there may be imitation or evocation of a traditional term within the meaning of that provision where that term is translated into a language other than that in which that term is given in Annex III to that regulation, if that translation is likely to cause confusion or to mislead the persons to whom it is addressed. It is for the national court to examine whether that is the case in the dispute before it. 3. Schneider au Land Rheinland-Pfalz (Land de Rhénanie-Palatinat) au sujet de l'utilisation des mentions "Réserve", "Grande Réserve", "Reserve" et "Privat-Reserve" pour la commercialisation de vins. Schneider est propriétaire d'une exploitation vinicole dans le Land de Rhénanie-Palatinat, inscrite au registre de commerce sous la raison sociale "Consulat des Weins". Un contrôle effectué au cours du mois de novembre 2002 a permis d'établir que M. Schneider produisait huit types de vins dont les étiquettes portaient la mention de la raison sociale de son exploitation ainsi que les mentions "Grande Réserve" pour deux vins de la catégorie de prix la plus élevée, "Réserve" pour quatre vins de prix moyen et "Terroir" ou "Terroir Palatinat" pour deux vins de la catégorie de prix la moins élevée. L'Aufsichts- und Dienstleistungsdirektion Trier : <ul id="s2h"><li> a interdit à M. Schneider de commercialiser les vins en question sous les mentions en langue française "Réserve" et "Grande Réserve". </li><li> a rejeté la réclamation par laquelle M. Schneider se disait prêt à faire usage, en lieu et place desdites mentions, des mentions en langue allemande "Reserve" ou "Privat-Reserve", </li><li> a indiqué que la mention "Privat-Reserve" ne pouvait pas non plus être acceptée. </li></ul> Différents appels n'ont pas abouti. Finalement le Bundesverwaltungsgericht a décidé de poser des questions préjudicielles à la Cour de Justice. 1. L'article 47, paragraphe 2, sous c), du règlement (CE) nº 1493/1999 du Conseil, du 17 mai 1999, portant organisation commune du marché vitivinicole, lu en combinaison avec l'annexe VII, B, point 3, de ce règlement et avec l'article 6, paragraphe 1, du règlement (CE) nº 753/2002 de la Commission, du 29 avril 2002, fixant certaines modalités d'application du règlement nº 1493/1999 en ce qui concerne la désignation, la dénomination, la présentation et la protection de certains produits vitivinicoles, tel que modifié par le règlement (CE) nº 1512/2005 de la Commission, du 15 septembre 2005, doit être interprété en ce sens que l'emploi d'une indication relative à une méthode de production, d'élaboration, de vieillissement ou à la qualité d'un vin ne peut être autorisé au titre de ces dispositions que si cette indication n'est pas susceptible de créer, dans l'esprit des personnes auxquelles celle-ci s'adresse, un risque de confusion entre ladite indication et les mentions traditionnelles complémentaires visées à ladite annexe VII, B, point 1, sous b), cinquième tiret, et à l'article 23 du règlement nº 753/2002. Il appartient à la juridiction de renvoi d'apprécier si les mentions en cause dans le litige au principal sont susceptibles de créer un tel risque. 2. L'article 24, paragraphe 2, sous a), du règlement nº 753/2002, tel que modifié par le règlement nº 1512/2005, doit être interprété en ce sens qu'il peut y avoir imitation ou évocation d'une mention traditionnelle au sens de cette disposition lorsque cette mention est traduite dans une langue autre que celle dans laquelle ladite mention est indiquée à l'annexe III de ce règlement dès lors que cette traduction est de nature à créer des confusions ou à induire en erreur les personnes auxquelles celle-ci s'adresse. Il incombe à la juridiction de renvoi d'examiner si tel est le cas dans le litige dont elle est saisie. 3.
